DocTurno Puerto Rico LLC (“DocTurno Puerto Rico,” “DocTurno,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use the DocTurno Puerto Rico website, mobile applications, and related technology services and features (collectively, the “Platform”).

This Privacy Policy applies to patients, parents, legal guardians, Authorized Representatives, Provider Organizations, Provider Personnel, and other users of the Platform.

This Privacy Policy does not replace a Provider Organization’s Notice of Privacy Practices. Your treating Provider Organization is responsible for its healthcare services, patient records, and privacy practices.

1. Information We Collect

We may collect information you provide directly, information generated through use of the Platform, and information received from Provider Organizations, Authorized Representatives, payment processors, and service providers.

1.1 Account, Contact, and Profile Information

This may include:

  • name;
  • email address;
  • telephone number;
  • date of birth;
  • mailing address, where provided;
  • username and account credentials;
  • profile photograph or other profile image, where provided;
  • preferred language or communication preferences, where available; and
  • information reasonably necessary to verify identity, account ownership, or authority to act for another person when needed to protect an account, prevent fraud, or address a request involving an Authorized Representative.

1.2 Patient, Appointment, and Telehealth Information

When patients, Authorized Representatives, Provider Organizations, or Provider Personnel use the Platform, we may collect:

  • provider-selection and appointment information;
  • appointment dates, times, locations, status, and cancellation information;
  • appointment requests, confirmations, reminders, cancellations, and other appointment-related notifications and communication records; telehealth-session information, including session dates, times, connection information, and technical logs;
  • real-time chat messages or other content exchanged through an active telehealth session;
  • information submitted through forms or support requests; and
  • other information a patient, Authorized Representative, Provider Organization, or Provider Personnel chooses to provide through the Platform.

DocTurno Puerto Rico does not provide healthcare services and is not responsible for medical decisions, diagnosis, treatment, prescriptions, or clinical records created by a Provider Organization.

1.3 Provider Organization and Provider Personnel Information

We may collect information about individual licensed healthcare providers, their authorized professional entities, and their authorized staff members (“Provider Personnel”), including:

  • provider names, professional titles, specialties, license numbers, where provided, profile photographs, and other provider profile information;
  • office and business information, including office location, office hours, insurance plans accepted, appointment availability, whether new patients are accepted, and whether in-person appointments, telehealth appointments, or both are offered;
  • selected subscription plan, billing period, subscription status, account-administration, billing, and payment information;
  • information about Provider Personnel added to a Provider Organization’s account, including their assigned roles and access permissions;
  • profile information, articles, blogs, and other content published through the Platform; and
  • information submitted for verification, onboarding, support, or account administration.

At this time, each Provider Organization account supports one individual licensed healthcare provider and that provider’s authorized staff members. The Platform does not currently support shared accounts for multiple independent treating providers or facility-level account management.

1.4 Payment, Wallet, and Provider Subscription Information

We and our payment-service providers may collect or process information needed to support payment-related functions through the Platform, including:

  • payment-method information;
  • payment authorization status, transaction amounts, transaction dates, and payment-related identifiers;
  • Patient Wallet balances, Wallet transaction history, refunds, reversals, cancellation fees, no-show fees, and other appointment-related payment activity;
  • Provider Wallet balances, transaction history, payments received for applicable appointments, transfers, and other payout-related activity;
  • bank-account information and transfer instructions provided by a Provider Organization to receive transfers from its Provider Wallet;
  • selected provider subscription plan, billing period, subscription status, subscription fees, and records of subscription payments made from a Provider Wallet or another payment method; and
  • information submitted in connection with payment-related support requests, disputes, refunds, reversals, transfers, or account reviews.

Payment, Wallet, and transfer functions may be processed by third-party payment-service providers. Their collection, use, and handling of payment information may also be subject to their own privacy policies and terms.

1.5 Device, Usage, and Technical Information

We may automatically collect technical information when you access or use the Platform, including:

  • device type, operating system, browser type, app version, and language settings;
  • IP address and device identifiers;
  • login activity, access dates and times, pages or features used, and activity logs;
  • crash reports, error logs, and performance data;
  • internet-service-provider or mobile-carrier information; and
  • approximate location information derived from an IP address.

If you choose to grant permission through your device settings, we may collect more precise location information only as needed to provide a requested Platform feature.

1.6 Cookies and Similar Technologies

We and our service providers may use cookies, pixels, local storage, software-development kits, and similar technologies to operate, secure, remember settings, analyze performance, and improve the Platform.

DocTurno Puerto Rico does not sell Protected Health Information (“PHI”) or use PHI for targeted advertising. We do not knowingly permit advertising technologies to receive PHI through the Platform.

You may be able to control certain cookies or similar technologies through your browser or device settings. Disabling some technologies may affect Platform functionality.

2. How We Use Information

We may use information for the following purposes:

  • to create, administer, and secure Platform accounts;
  • to provide appointment scheduling, reminders, administrative notices, telehealth functionality, real-time chat, and other Platform features;
  • to facilitate patient appointment payments, Wallet functions, refunds, payment holds, and subscription payments;
  • to provide support, respond to questions, and resolve technical or account issues;
  • to verify Provider Organization and Provider Personnel information for administrative purposes;
  • to display provider profiles, appointment availability, articles, blogs, and other content selected for publication;
  • to maintain, troubleshoot, protect, improve, and develop the Platform;
  • to detect, investigate, and prevent fraud, security incidents, misuse, unauthorized access, and violations of our Terms;
  • to comply with legal obligations, enforce our agreements, and protect the rights, safety, and property of DocTurno Puerto Rico, users, Provider Organizations, and others;
  • to create de-identified or aggregated information in accordance with applicable law; and
  • for any other purpose disclosed to you at the time information is collected or with your consent.

3. How We Disclose Information

We may disclose information as described below.

3.1 Provider Organizations and Provider Personnel

We may make patient, appointment, telehealth, payment, and other Platform information available to the applicable Provider Organization and its authorized Provider Personnel as necessary to provide, administer, support, and manage the services selected through the Platform.

Provider Organizations are responsible for determining which Provider Personnel may access patient information through their accounts.

3.2 Authorized Representatives and Family Profiles

If a patient profile is created or managed by an Authorized Representative, we may make information available to that Authorized Representative as permitted by applicable law and the Platform’s access controls.

An Authorized Representative’s access may be limited, changed, or removed when required by law, a Provider Organization’s instructions, a patient’s legal rights, or Platform security requirements.

3.3 Service Providers and Subcontractors

We may disclose information to service providers and subcontractors that help us operate the Platform, including providers of:

  • cloud hosting, data storage, backup, and Platform-maintenance services;
  • telehealth, video, audio, and real-time chat technology;
  • payment processing, Patient Wallet, Provider Wallet, bank-transfer, and payout services;
  • electronic communications and notification services;
  • security and technical-support services; and
  • professional services, where needed.

These parties may access, receive, maintain, or process information only as necessary to provide services for DocTurno Puerto Rico and are subject to applicable contractual confidentiality, privacy, security, and other legal obligations.

Where a service provider creates, receives, maintains, or transmits Protected Health Information on behalf of DocTurno Puerto Rico, we require appropriate safeguards and agreements as required by applicable law.

3.4 Legal, Safety, and Compliance Purposes

We may use or disclose information when we reasonably believe it is necessary to:

  • comply with applicable law, regulation, legal process, court order, subpoena, or government request;
  • protect the rights, privacy, safety, or property of DocTurno Puerto Rico, users, Provider Organizations, Provider Personnel, or the public;
  • investigate or respond to suspected fraud, security incidents, or violations of our Terms; or
  • enforce our agreements and policies.

3.5 Business Transactions

If DocTurno Puerto Rico is involved in a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law.

3.6 With Your Direction or Consent

We may disclose information when you direct us to do so or provide consent for a specific disclosure.

4. PHI and Healthcare Privacy

Provider Organizations may use the Platform to create, receive, maintain, or transmit PHI.

When DocTurno Puerto Rico handles PHI on behalf of a Provider Organization, DocTurno Puerto Rico acts as a business associate of that Provider Organization where applicable. In that role, DocTurno Puerto Rico handles PHI as permitted by the applicable Business Associate Agreement, the Provider Organization’s instructions, and applicable law.

The applicable Provider Organization is responsible for:

  • providing healthcare services;
  • maintaining required patient records;
  • obtaining required patient consents and authorizations;
  • providing its Notice of Privacy Practices;
  • responding to patient requests concerning healthcare records, including requests for access, amendment, restrictions, or accounting of disclosures; and
  • complying with its own legal and professional obligations.

Questions about a Provider Organization’s healthcare services, clinical records, or Notice of Privacy Practices should be directed to the applicable Provider Organization.

5. Patient Wallet, Provider Wallet, and Payment Privacy

Patient Wallet balances may be used only for eligible appointment-related charges presented through the Platform.

Provider Wallet balances may reflect payments received for applicable appointments and may be used for eligible subscription payments or transferred to a bank account designated by the applicable Provider Organization through available Platform functionality.

We may use Wallet, payment, bank-account, and related information to:

  • add, maintain, and display Patient Wallet and Provider Wallet balances and transaction history;
  • authorize, process, settle, reverse, or refund payments;
  • apply disclosed cancellation or no-show fees;
  • process payments received for applicable appointments, Provider Wallet transfers, and subscription payments;
  • verify provider bank-account and payout information where needed to process transfers;
  • investigate suspected errors, fraud, or unauthorized activity;
  • comply with payment-processor, financial, and legal requirements; and
  • provide transaction records and support.

Patient Wallets and Provider Wallets are not bank accounts, deposit accounts, or lines of credit, and Wallet balances do not earn interest.

Unused Patient Wallet funds may be refunded as described in the applicable Terms and subject to payment-processor requirements, identity verification, and applicable law. Provider Wallet transfers and other Provider Wallet activity are subject to the applicable Terms, payment-processor requirements, and applicable law.

6. Your Choices and Rights

6.1 Account Information

You may review and update certain account information through the Platform. You are responsible for keeping your contact information accurate and current.

6.2 Privacy Requests

You may contact us to request access to, correction of, or deletion of personal information that DocTurno Puerto Rico maintains about you, subject to applicable law and our legal obligations.

Some requests may need to be directed to the applicable Provider Organization, particularly where they concern PHI, medical records, treatment information, or records that the Provider Organization is required to retain.

6.3 Communications

We may send account, appointment, payment, Wallet, subscription, security, and other service-related communications through the Platform or through contact information associated with a user’s account, including email and push notifications where available.

We may continue to send communications that are necessary to administer an account, provide Platform services, protect security, respond to a request, or comply with applicable law.

6.4 Device Permissions

You may change device permissions, such as notification or location permissions, through your mobile-device settings. Disabling permissions may limit certain Platform features.

7. Data Retention

We retain information for as long as reasonably necessary to:

  • provide the Platform and maintain user accounts;
  • support Provider Organizations;
  • complete payment, Wallet, subscription, and transaction activities;
  • comply with legal, accounting, tax, healthcare, privacy, security, and record-retention obligations;
  • resolve disputes and enforce agreements; and
  • maintain appropriate business and security records.

Provider Organizations, not DocTurno Puerto Rico, are responsible for determining and meeting their own medical-record retention obligations.

When information is no longer needed, we may delete, de-identify, aggregate, or securely retain it as permitted or required by applicable law.

8. Security

We use reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction.

No system, transmission, or storage method is completely secure. You are responsible for protecting your account credentials and promptly notifying us of suspected unauthorized account activity.

If we determine that a security incident requires notice under applicable law, we will provide notice as required.

9. Children and Family Profiles

The Platform is not intended for an individual under eighteen (18) to create an independent account unless that individual is legally able to enter into the applicable Terms.

A parent, legal guardian, or other person legally authorized to act on behalf of a minor or other individual may create or manage a family member or dependent profile through the Platform.

If you believe information has been collected through the Platform without proper legal authorization, contact us using the information below.

10. Third-Party Services and Links

The Platform may contain links to, integrate with, or rely on third-party services. This Privacy Policy does not govern the privacy practices of third parties, including Provider Organizations, payment processors, mobile-application stores, internet-service providers, mobile carriers, or external websites.

We encourage you to review the privacy policies of those third parties before providing information to them.

11. International and Cross-Border Processing

DocTurno Puerto Rico and its service providers may process information in Puerto Rico, the United States, and other locations where DocTurno Puerto Rico or its service providers operate.

Where PHI is involved, DocTurno Puerto Rico will handle PHI in accordance with the applicable Business Associate Agreement and applicable law.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the most current version through the Platform and on our website, with an updated “Last Updated” date.

If a change is material, we may provide additional notice through the Platform, by email, or by another reasonable method.
